1. Agreement to Terms

By accessing or using TAPilot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and TAPilot. Please read them carefully.

2. Description of Service

TAPilot is an AI-powered CV analysis and recruitment intelligence platform that provides:

  • CV/resume analysis with competency scoring (GEM Analysis)
  • CV-to-Job Description matching (FIT Matching)
  • AI-generated interview questions
  • Batch CV processing
  • Career guidance and insights through AI agents

3. Account Registration

To use TAPilot, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account and use the Service.

4. Acceptable Use

You agree NOT to:

  • Upload CVs or documents without proper authorization from the CV owner
  • Use the Service for any unlawful purpose or discrimination
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Upload malicious files, viruses, or harmful content
  • Use automated scripts to access the Service (except via our API)
  • Share your account credentials with others
  • Resell or redistribute the Service without authorization
  • Use the Service to make final hiring decisions without human review

5. CV Data and Authorization

5.1 Your Own CV (Self-Analysis)

When you upload your own CV for analysis, your use of the Service constitutes consent to process your CV, including transmission to third-party AI services (OpenAI) as described in our Privacy Policy.

5.2 Third-Party CVs (Recruiters, HR Teams, Organizations)

Important: If you are uploading CVs belonging to other individuals (e.g., job applicants, candidates), you represent and warrant that:

  • You are acting as a Data Controller and TAPilot is your Data Processor
  • You have a lawful basis to process the candidate's CV (e.g., consent, legitimate interest for recruitment purposes, or contractual necessity)
  • Candidates have been informed, or you will inform them, that their CV may be processed using AI-powered screening tools and third-party AI services
  • You have updated, or will update, your organization's privacy notice to disclose the use of TAPilot and AI-based CV analysis
  • You will respond to any data subject requests (access, deletion, correction) from candidates regarding their CV data
  • You will use the analysis results in compliance with applicable employment, anti-discrimination, and data protection laws

5.3 Recommended Privacy Notice Language

Organizations using TAPilot should consider adding language similar to the following to their candidate-facing privacy notices:

"We may use AI-powered tools and services to assist in evaluating your application. This may include automated analysis of your CV/resume by third-party AI systems. Such processing is used to support, not replace, human decision-making in our recruitment process."

5.4 Implied Consent from Job Applications

We acknowledge that candidates who submit CVs through job applications may have provided implied consent for their CV to be processed as part of the recruitment process. However, the use of AI tools may extend beyond what candidates typically expect. To ensure compliance with PDPA and build trust:

  • We recommend explicit disclosure that AI tools are used in your recruitment process
  • Where feasible, provide candidates the option to opt out of AI-assisted screening
  • Ensure that AI analysis is used to support, not replace, human judgment in hiring decisions

5.5 Data Processing Agreement

Enterprise customers processing significant volumes of candidate CVs may request a formal Data Processing Agreement (DPA) that documents the data controller/processor relationship and respective obligations. Contact [email protected] for DPA requests.

6. AI Processing and Third Parties

TAPilot uses artificial intelligence to analyze CVs and provide insights. By using the Service, you acknowledge and consent that:

  • CV content is processed using OpenAI's API services
  • Data is transmitted to and processed by OpenAI's servers in accordance with their policies
  • AI-generated analysis is provided as guidance and should not be the sole basis for hiring decisions
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated insights

Human judgment should always be applied when making employment decisions.

7. Intellectual Property

Our Property: The Service, including its design, features, AI models, and content (excluding user-uploaded data), is owned by TAPilot and protected by intellectual property laws.

Your Content: You retain ownership of the CVs and documents you upload. By uploading content, you grant us a limited license to process it for the purpose of providing the Service.

Analysis Output: You may use the analysis results generated for your CVs for your legitimate business or personal purposes.

8. Subscription and Payments

Certain features of TAPilot may require a paid subscription or credit purchase:

  • Prices are displayed in your local currency or USD
  • Payments are processed securely through Stripe
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Credits are non-refundable once used
  • We reserve the right to modify pricing with 30 days notice

9. Free Trial

We may offer free trial access with limited features or credits. Free trials:

  • Are limited to one per user/organization
  • May be modified or discontinued at any time
  • Do not guarantee access to all features

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Accuracy or reliability of AI-generated analysis
  • Uninterrupted or error-free operation
  • Suitability for making hiring or employment decisions

You acknowledge that AI analysis has limitations and may contain errors. Always apply human judgment to hiring decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPILOT SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, data loss, or business interruption
  • Hiring decisions made based on AI analysis
  • Any claims arising from your use of third-party services

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless TAPilot from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your unauthorized uploading of CVs or personal data
  • Your use of analysis results in a discriminatory or unlawful manner
  • Any third-party claims related to your use of the Service

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination:

  • Your access to the Service will cease immediately
  • We will delete your data in accordance with our Privacy Policy
  • Unused credits or subscription fees are non-refundable

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore, unless otherwise required by applicable consumer protection laws.
